Recent Cases Before the Supreme Court of Texas
- No. 00-0903 John Wood Group USA, Inc. v. ICO, Inc., 26 S.W.3d 12 (Tex. App.-Houston [1st Dist.] 2000, pet. denied). Breach of contract case. Court of appeals reversed $20 million judgment. Supreme Court denied review after full briefing.
- No. 01-0346 PPG Indus., Inc. v. JMB/Houston Ctrs. Partners Ltd. P'ship, 146 S.W.3d 79 (Tex.2004). DTPA/breach of warranty case. Supreme Court granted our petition for review and, after oral argument, decided new issues of law, holding, among other things, that the DTPA was not assignable.
- No. 01-0534 Progressive County Mut. Ins. Co. v. Sink, 107 S.W.3d 547 (Tex.2003). Insurance coverage case. Supreme Court granted our petition for review and, after hearing oral argument, reversed and rendered judgment for Progressive.
- No. 01-1040 Sanchez v. Brownsville Sports Center, Inc., 51 S.W.3d 643 (Tex. App.-Corpus Christi 2001, pet. dism'd by agmt). Product liability case. Court of Appeals rendered $30 million judgment against Honda. Supreme Court granted our petition for review and heard oral argument. After oral argument, the plaintiff attorney settled for a nominal amount.
- No. 03-0457 No. 03-0482 In re Texas-New Mexico Pipeline Co. (Filed May 27, 2003). Oil and gas case. After full briefing, Supreme Court denied two petitions for writ of mandamus, allowing the case to go to trial, where we received verdict (on behalf of EOTT) for over $30 million.
- No. 03-0597 Honda of America Mfg., Inc. v. Norman, 104 S.W.3d 600 (Tex. App.-Houston [1st Dist.] 2003, pet. denied). Product liability case. Court of appeals reversed and rendered $65 million judgment. After full briefing, Supreme Court denied petition for review.
- No. 03-0692 Jojos Restaurants, Inc. v. McFadden, 117 S.W.3d 279 (Tex. App.-Amarillo 2003, pet. denied). Premises liability case. Court of appeals reversed and rendered judgment in drive-by shooting case. After briefing, Supreme Court denied review.
- No. 04-0055 Progressive County Mut. Ins. Co. v. Boyd, 177 S.W.3d 919 (Tex.2005). Insurance coverage case. Supreme Court granted our petition for review and, after full briefing, without hearing oral argument, reversed and rendered for Progressive.
- No. 04-0465 City of Houston v. Jackson, 49 Tex. Sup. Ct. J. 492, 2006 Tex. Lexis 258 (Argued October 20, 2005, decided April 7, 2006). Statutory construction case. Supreme Court granted petition for review and, after full briefing and oral argument, reversed and rendered take nothing judgment for Jackson.
- No. 04-0930 City of Houston v. Clark. Statutory construction case. Supreme Court granted petition for review. Argued November 16, 2005; awaiting decision.
- No. 04-1107 Tran v. Macha ,176 S.W.3d 128 (Tex. App.-Houston [1st Dist.] 2004, pet. pending). Adverse possession case. Supreme Court issued it's per curiam opinion on December 1, 2006 and without hearing argument reversed the court of appeals and rendered judgment for the petitioners.
- No. 05-0066, 05-0115 In re Enron Capital Mgmt. and In re EOG Resources, Inc. (Filed January and February, 2005). Oil and gas/fraud case. After full briefing on petitions for writ of mandamus to compel arbitration, Supreme Court denied petitions.
